There will be an appeal, possibly to the 9th circuit for a en banc hearing.  The 9th circuit can accept or reject this request.

Then if the 9th circuit rejects this request and/or the appeal is not made, the matter can then be appealed to the Supreme Court, which may or may not take the case.

If the Supreme Court takes the case, even a ruling that finds Prop 8 unconstitutional may not address equal marriage as a constitutional right (which would have impact nationwide, not just in California), but might just address various legal processes, including whether California had justification in assigning different laws to different classes of people (something that can be done where there is an actual reason to do so — think about how minors are moved through the court system differently.  It’s not an entirely accurate comparison, but it makes the point).

So this is good, but more things are going to happen.

We don’t know what they are, how quickly they will happen, or how broad their impact will be.

What we do know is that this decision comes as marriage equality is being considered in Washington, Maine, Maryland and New Jersey.

Washington is expected to pass the law and the governor to sign, but there is a campaign underway by bigots — and I will not call them anything else at this point — to garner enough signatures to prevent the law from taking effect without a public referendum first.

NJ may pass marriage in its legislature, but the governor says he will not sign and wants it to go to the people.

Last I heard Maryland was far away on this; not sure where Maine stands, but have heard it is ugly).
